1. Acceptance of Terms

By downloading, installing, or using Mushroom Identifier ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

2. Description of Service

Mushroom Identifier is a mobile application that uses artificial intelligence to suggest the likely species of a mushroom from a photograph, and to present an educational risk classification together with dangerous look-alike species. The App is developed and published by Bulpara Inc.

3. Not a Guide to Foraging or Consumption

The App must never be used to decide whether any mushroom, fungus, or other organism is safe to eat. It does not provide foraging, culinary, medical, or dosage advice, and it will not tell you that anything is safe for consumption.

Species identifications and risk classifications are AI-generated, probabilistic, and may be wrong. Independent testing has found mushroom identification applications to be correct only around half of the time, with deadly look-alikes such as Amanita and Galerina species misidentified in a substantial share of cases. A classification of "Reportedly edible" is a statement about what references say regarding a species in general; it is never a statement about your specimen and never a recommendation.

Correct identification of wild fungi requires physical examination by a qualified expert, and frequently spore prints, microscopy, and habitat context that no photograph can supply. Always consult a qualified mycologist or your local mycological society.

4. No Warranty of Safety

Eating wild mushrooms carries a risk of serious illness, organ failure, and death. Many deadly species closely resemble edible ones, and some produce no symptoms until irreversible damage has occurred. No output of the App — including a low risk classification, a high confidence score, or an empty look-alike list — constitutes a warranty, assurance, or indication that anything is safe to eat, touch, or handle. You assume all risks associated with any mushroom identified or assessed by the App.

5. User Responsibilities

You are responsible for ensuring your use of the App complies with all applicable laws, including those governing foraging, collection, and trespass. You must be at least 13 years of age to use the App. You agree not to rely on the App for emergency, medical, or life-safety decisions, and not to present its output to others as an authoritative identification.

6. Intellectual Property

The App, including its code, design, icons, AI models, and branding, is the intellectual property of Bulpara Inc. and is protected by applicable copyright and trademark laws. Your submitted photos and the analyses you receive belong to you.

7. Subscription Terms

Premium features require an active subscription. Pricing:

Subscriptions are managed through Apple App Store. Billing, renewal, and cancellation are governed by Apple's terms and policies. You can manage or cancel your subscription at any time through your Apple ID account settings.

8. Auto-Renewal

Payment will be charged to your Apple ID account at confirmation of purchase. Subscription automatically renews unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your App Store account settings after purchase.

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, in no event shall Bulpara Inc. be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App — including but not limited to poisoning, illness, injury, or death resulting from the consumption or handling of any mushroom or other organism that the App identified, classified, or described. Some jurisdictions do not allow the exclusion of liability for personal injury; in those jurisdictions our liability is limited to the minimum extent permitted by applicable law.

12. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the transmission of your photos to our servers for AI analysis as described in the Privacy Policy.

13. Termination

We reserve the right to terminate or suspend access to the App for users who violate these terms or abuse the service. You may stop using the App at any time by uninstalling it.

14. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be reflected in the "Last Updated" date above. Continued use of the App after changes constitutes acceptance of the updated terms.
